Please read these Terms of Service ("Terms") carefully before using the Club YAP mobile application ("the App"). By downloading or using the App, you agree to be bound by these Terms.

1. Who We Are

Club YAP is an independently developed app, not part of a larger language-learning company.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you confirm that you meet this requirement. If you are under 18, you must have consent from a parent or guardian.

3. Account Registration

To use the App, you must create an account using a valid email address, or sign in with Google or Apple.

You are responsible for:

• Keeping your login credentials secure.
• All activity that occurs under your account.
• Providing accurate information during registration.

We reserve the right to suspend or delete accounts that violate these Terms or that show signs of fraudulent activity.

4. Subscriptions and Billing

4.1 Free Plan

A free tier is available with limited daily video goals and access to the core learning features.

4.2 Club YAP Pro Subscription

Club YAP Pro is an optional paid subscription that unlocks additional features. Pricing is displayed within the App at the time of purchase.

• Subscriptions are billed monthly or annually, depending on the plan you select.
• A 7-day free trial is available to new Pro subscribers. You will not be charged during the trial period. If you do not cancel before the trial ends, billing begins automatically.
• Subscriptions renew automatically at the end of each billing period unless cancelled.

4.3 Managing and Cancelling Subscriptions

You may cancel your subscription at any time through iOS Settings → Apple ID → Subscriptions, or via the Manage Subscription button in the App (Profile → Account).

Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time except where required by applicable law.

4.4 Refunds

Refund requests are handled by the App Store (Apple) under its refund policy. We do not process refunds directly.

4.5 Price Changes

We reserve the right to change subscription prices. We will give you at least 30 days' notice of any price change by notifying you in-app or by email. Continued use after the change takes effect constitutes acceptance.

5. Licence and Permitted Use

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial language learning.

You may not:

• Copy, modify, or distribute the App or its content.
• Reverse engineer or attempt to extract the App's source code.
• Use the App for any unlawful purpose.
• Attempt to bypass account or subscription restrictions.
• Use automated tools (bots, scrapers) to interact with the App.

6. Content

6.1 Video Content

Videos shown in the App are sourced from third-party creators on TikTok. When you tap to watch a video, it opens in your device's browser. We are not responsible for the content of third-party websites or video platforms, and their own terms of service apply.

6.2 Educational Content

The phrases, translations, and quiz questions provided in the App are generated with the assistance of AI language models as part of our content pipeline, then used to build the videos and quizzes you see. While we aim for accuracy, we do not guarantee that all content is error-free. Do not rely on the App as your sole source for critical language requirements (e.g. legal, medical, professional interpretation).

6.3 Quiz Scoring

Quizzes are multiple-choice, with the correct answer determined ahead of time when the video is processed — scoring your attempt is a simple correct/incorrect check, not a real-time AI judgment of your answer.

7. User Data and Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the data practices described there.

8. Account Deletion

You may delete your account at any time in the App (Profile → Account → Delete Account). Account deletion is subject to a 30-day retention window as described in our Privacy Policy.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted or error-free.
• Any errors will be corrected.
• The App or its servers are free of viruses or harmful components.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR £50, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages (including reasonable legal fees) arising from your violation of these Terms or your use of the App.

12. Changes to the App

We may update, modify, or discontinue any part of the App at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

13. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect the most recent revision. Continued use of the App after changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
